| Not to mention that Bush v. Gore did not hold that the US Supreme Court has the right to decide who wins the 2000 presidential election. The Court held in that case, by a 7-2 margin, that the process by which the Florida Supreme Court decided to recount the votes violated the Equal Protection rights of the voters in Florida because the Florida Supreme Court failed to dictate to the local electoral boards how the re-count was to be carried out. This meant that votes would be counted using different standards in different counties, which necessarily meant that some votes that would be counted in some counties would not be counted if they had been recorded in other counties; so, whether your vote would count depended on where you cast it. The Supreme Court also held, by a 5-4 margin, that there was not enough time to establish a uniform re-count process because of the deadline that was approaching to finalize the results; so, the Court ordered the Florida Supreme Court to halt the re-count. |
