@epicirish: To expand on what Flick said, a key reason for such "etiquette" is that very often a game creator is already planning or preparing a sequel or a variation on their game. If slipkid already had a sequel in progress using several of these words, it would rob them of continuing to expand on the idea or theme they had originated. So this applies more to the "content" or "theme" usually than to how you physically "lay the game out" (Not to mention, a lot of work may have already been done, and "wasted").
Personally, I view such matters sort of like an "imaginary copyright" and I try to make great efforts to research the Sporcle archives before making a game to avoid "potentially stepping on the toes of" another contributor. But once a format or theme becomes "mainstream" it as if a copyright had "expired." Sort of like how Classical music can be copied or varied, and performed by anyone nowadays.
A good idea is to leave a comment in the original author's game asking how they feel about your continuing of the format or theme. Like Flick said, I've also noticed that the vast majority of writers will say "sure, no problem!" :)
